11. Consent
11.1. By checking the consent box, members are confirming that they authorise Wyndham Destinations Asia Pacific Pty Ltd and its related entities to use their contact details (residential and electronic messaging) and telephone number(s) (work, mobile and home/private) provided in this Terms of Use form for sales and marketing purposes, in particular, for the purpose of offering the opportunity to attend a timeshareDestinations sales presentation on the WorldMark South Pacific Vacation Ownership program, for an indefinite period, or until they opt out.

12.1. Upon activation of your Lifestyle by Wyndham membership, you agree that we may store, process and use the information collected during your registration process for the purposes of processing your activation, promoting the Lifestyle by Wyndham Program and/or offering you products on or related to Lifestyle by Wyndham benefits.
12.2. You further agree that we may pass your information on to the relevant supplier or operator to enable them to complete and facilitate any transaction you may wish to make as part of the Lifestyle by Wyndham membership. Please refer to Wyndham Destinations Asia Pacific’s Privacy Policy for further information.
13. General
13.1. You cannot and will not assign any rights and obligations under these Terms whether in whole or in part without the prior written consent of Wyndham.
13.2. If any part of these Terms are held to be invalid or unenforceable in whole or in part by a relevant governing or legal body the validity of the remaining parts of the Terms and Conditions shall not be affected.
13.3. Neither our failure or delay nor your failure or delay to exercise any Term contained in this document will constitute a waiver of such Term. None of Wyndham‘s employees, affiliates or agents has the authority to vary any of the Terms contained herein.
13.4. The Terms and access to the Lifestyle program are governed by and will be construed in accordance with the laws of the State of Queensland Australia irrespective of where the application for activation has been completed by the Lifestyle by Wyndham member or submitted to Wyndham. In any action or other legal process with respect to any matter or thing in connection with these Terms or the parties submit to the non-exclusive jurisdiction of the State of Queensland.
13.5. The Lifestyle program is offered to those who are 18 years and over. By using our website to access the Lifestyle program, you are confirming that you are 18 years or over.
14. Force Majeure
Wyndham shall not be held liable for any delay in performing any obligations under these Terms and Conditions to the extent that such delay is caused by circumstances beyond Wyndham’s reasonable control. In such circumstances where delay is caused due to no fault of Wyndham, Wyndham will be entitled to a reasonable extension of time for the performance of such obligations.
15. Lifestyle by Wyndham program
15.1. Lifestyle by Wyndham is a member benefit program offered by Wyndham, which may be terminated by Wyndham at its sole discretion, and does not and is not intended to fall within the ambit of AFS Licence No. 225200 held by Wyndham Vacation Resorts South Pacific Ltd ACN 090 503 923.
15.2. No costs associated with Lifestyle by Wyndham are passed on to the WorldMark South Pacific Club.
15.3. Participation in the Lifestyle program is separate from Ownership in WorldMark South Pacific Club and can be modified or discontinued at any time.
16. Payment
16.1. We accept payment by Credit Card only via a payment gateway, excluding PayPal, for item purchased on the Lifestyle by Wyndham website.
16.2. All amounts for payment are in Australian currency and include GST where applicable.
